Terms of Service

1. Acceptance

By creating an account or using myphonely ("Service"), you agree to these Terms. If you do not agree, do not use the Service. These Terms form a binding agreement between you and myphonely ("we", "us").

2. What the Service provides

myphonely provides a relay infrastructure that connects your Android device (via the myphonely app) to AI clients using the Model Context Protocol (MCP). We route ADB commands between your device and authorized AI clients. We do not provide the AI model itself.

3. Your responsibilities

  • You must own or have authorization to use the Android device you connect.
  • You are solely responsible for all actions taken on your device through the Service, whether performed by you or by an AI agent acting on your behalf.
  • You must comply with the terms of service of any third-party platform (Instagram, Reddit, LinkedIn, etc.) you interact with using the Service.
  • You must not use the Service to send spam, harass others, violate any law, or engage in any activity that could harm third parties.
  • Keep your API key confidential. You are responsible for all usage under your key.

4. Credits and payment

  • The Service is metered by credits. Credits are deducted per API call.
  • Credits do not expire.
  • Credits are non-refundable except where required by law.
  • Prices may change with 30 days notice.
  • Payment is processed by Stripe. By purchasing credits you agree to Stripe's terms.

5. Prohibited uses

You may not use the Service to:

  • Automate actions that violate any platform's terms of service at scale.
  • Access accounts you do not own or have explicit authorization to use.
  • Conduct any illegal activity.
  • Resell or sublicense access to the Service without our written consent.
  • Attempt to reverse-engineer or circumvent our relay infrastructure.

6. Termination

We may suspend or terminate your account at any time for violation of these Terms, suspected abuse, or non-payment. You may cancel your account at any time by emailing help@myphonely.ai. Unused credits are non-refundable on termination.

7. Disclaimer of warranties

The Service is provided "as is" without warranty of any kind. We do not guarantee uptime, accuracy, or fitness for any particular purpose. Use of AI agents to automate device actions carries inherent risk; you accept that risk.

8. Limitation of liability

To the maximum extent permitted by law, myphonely is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to account bans on third-party platforms, data loss, or unauthorized actions taken by AI agents. Our total liability to you shall not exceed the amount you paid us in the 30 days preceding the claim.

9. Intellectual property

The myphonely app, relay server, and website are owned by myphonely. You may not copy, modify, or distribute them without our written permission.

10. Governing law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.

11. Changes

We may update these Terms. We will post the revised version here with a new date. Continued use after changes constitutes acceptance.
